Missouri Court of Appeals sends Columbia’s Spurlock lawsuit case back to Boone County; case involves whistleblower statute

A three-judge panel of the Missouri Court of Appeals has issued a unanimous ruling that says the city of Columbia lacks legal standing to challenge the constitutionality of a Missouri state law that protects government whistleblowers.

The 11-page ruling sends the case involving former Columbia city employee Colleen Spurlock back to Boone County Circuit Court.

Then-Columbia city manager John Glascock accused Spurlock of insubordination in 2021 and gave her the opportunity to resign with two weeks’ salary or be fired. She resigned the following morning, and accused Glascock of abusing his power. Glascock says Spurlock had criticized an assistant city manager and had inserted herself into a travel-related decision he made about her domestic partner, who also worked for the city. According to the ruling, Glascock learned after a June 2021 vacation that Spurlock, her domestic partner and some employees of the city’s IT and finance departments attended a council meeting in support of amending a pay raise ordinance. No amendment to the ordinance was proposed, and Spurlock quotes the assistant city manager as saying Glascock didn’t want to move forward with the amendment at that time.

Glascock viewed the employees’ attendance at the meeting as a betrayal of his leadership, according to Tuesday’s ruling. Spurlock’s lawsuit accuses Glascock of abuse of power.

Tuesday’s ruling, which is written by Judge Edward Ardini, reverses Boone County Judge Brouck Jacobs’ decision to dismiss Spurlock’s lawsuit. The case has been remanded to Boone County Circuit Court.

Glascock has since retired. 939 the Eagle News called Columbia spokeswoman Sydney Olsen regarding the court ruling. Ms. Olsen tells 939 the Eagle that she cannot comment on pending litigation.

UPDATE: Columbia psychologist Bumby receives maximum sentence for sex crimes

A Columbia psychologist convicted of statutory sodomy has been sentenced to seven years in prison.

Boone County Circuit Judge Brouck Jacobs sentenced 53-year-old Kurt Bumby this morning, noting the seven-year sentence is the maximum under Missouri state law. That’s also what the jury recommended.

Judge Jacobs blasted Bumby in open court, saying he leaves behind two victims and that they’re both doing better, no thanks to Bumby. The judge also fined Bumby $5,000.

Bumby appeared for his sentencing via video from the Boone County jail wearing a jail jumpsuit. He did not display any emotion in court. One of the victims’ mothers appeared in court, but she did not testify. She did testify during the trial, and Judge Jacobs took her testimony into account.

Boone County prosecutor Olufunmike Owoso tells the court that one victim was repeatedly sexually assaulted. Judge Jacobs has rejected defense attorney Joel Schwartz’s motion for a new trial.

Sentencing is today for Columbia psychologist convicted of sodomy

A Columbia psychologist convicted of sex crimes will be sentenced Friday morning in Boone County Circuit Court.

53-year-old Kurt Bumby was convicted in March on one count of second degree statutory sodomy, a class C felony. The jury recommends a seven-year prison sentence.

Judge Brouck Jacobs will sentence Bumby at 10 am. It’s unclear if Bumby will take the witness stand during his sentencing hearing. He will have the opportunity to address the court.

Because of his conviction, Bumby will be required to register as a sex offender for the rest of his life.

April sentencing set for Columbia psychologist convicted of sex crimes

A Columbia psychologist convicted of statutory sodomy will be sentenced in April.

53-year-old Kurt Bumby was convicted last week on one count of second degree statutory sodomy, a class C felony. The jury is recommending a seven-year prison sentence and a fine against Bumby, whose bail has been revoked.

He’ll be held at the Boone County jail until he’s sentenced on April 14. Judge Brouck Jacobs will sentence Bumby on April 14.

Boone County Circuit Judge Brouck Jacobs ruled in late January that Columbia Public Schools (CPS) violated state statute in former State Rep. Chuck Basye’s CPS school board filing case. Judge Jacobs ordered Boone County’s clerk to add Basye’s name to the April school board ballot, which she’s done. The former Missouri House Elementary and Secondary Education Committee chair is one of seven candidates on the April 4th ballot. The Rocheport Republican joined host Fred Parry in-studio for the hour Saturday morning on 939 the Eagle’s “CEO Roundtable,” telling listeners there is no political diversity on the Columbia school board.
